New pretrial conference set for Cody Bacon homicide case

A new pretrial conference has been set for Cody Bacon, who is charged with two counts of murder and two counts of first-degree wanton endangerment in relation to the deaths of his brother, David A. Pace, 24, and Pace’s wife, Brittany R. Pace, 22, at the couple’s Glasgow home on Sept. 2, 2021.
Bacon was in Barren Circuit Court for a discovery conference Monday. Discovery includes the process of each side’s – the defense and prosecution – gathering and/or sharing any evidence each has in the case that they are legally bound to disclose to the other.
Defense co-counsel Lauren Hunter advised Circuit Judge John T. Alexander that she is awaiting a couple of types of records she has requested, including certain ones pertaining to Bacon’s father for which she needed a court order, and at least some of those records are to be sent to an expert witness, who would then provide a report.
Alexander said he thought it may be a bit “ambitious” to think that the records would be received and forwarded and a report then received by that expert by June 26, when a pretrial conference had been previously scheduled, and Hunter and Commonwealth’s Attorney John Gardner agreed to reset that pretrial conference for July 31.
Bacon has remained lodged in the Barren County Detention Center since Sept. 2, 2021, in lieu of a $500,000 cash bond, according to court records.
Gardner has filed a notice that he intends to prosecute the case as a death-penalty case.
