The defendant accused in a fatal shooting early this year has decided to see whether a resolution to his case can be reached using mediation.
James Edward Campbell, 46, is accused of killing Roger L. Noland, 35, of Scottsville on Feb. 10 following an alleged confrontation in the parking lot outside Campbell’s residence in Glasgow.
In addition to his murder charge, Campbell is facing two counts of first-degree wanton endangerment due to the allegation that two other people were in Noland’s vicinity when the shots were fired. Noland was transported after the incident to T.J. Samson Community Hospital, where he was pronounced dead.
At his last pretrial conference, in November, trial dates were set for early September 2024.
At his appearance in Barren Circuit Court on Monday, Assistant Commonwealth’s Attorney Resa Gardner said she had received a request from defense attorney Johnny Bell that day asking for specific pieces of evidence, but she hadn’t had a chance to review it. She noted they had mentioned the idea of mediation before.
“I don’t believe he has any objection to exploring that, and I would like to do that earlier on in the year,” she said, suggesting they set another pretrial conference for March.
Circuit Judge John T. Alexander asked whether they wanted him to go ahead and request/assign a mediator, to which he received affirmation from Bell, so he said he would get that started. The person assigned will get notification of that and then typically reaches out to the attorneys for both sides to set up a meeting at a mutually agreeable time with the mediator and both sides present to see whether they can reach a resolution with all the relevant parties in the room.
“That should be doable by March, so we could put this [next pretrial conference] in the middle of March,” the judge said.
With the agreement of the attorneys, the date was set for March 18.
