The seven magistrates, representing the seven divisions of Barren County, and Judge-Executive Jamie Bewley Byrd are scheduled to meet in the Barren County Fiscal Court chambers to discuss a variety of county-related agenda items including the second reading of a budget ordinance, approval of an “amended animal control interlocal agreement” and a nursing home bond issue.
The meeting, set to be called to order at 9 a.m., will include numerous “par-for-the-course” items such as the public official, department and committee reports, however the agenda features 16 “new business” items which includes a “second reading of Ordinance #691” which amends a previous budget ordinance.
The amending ordinance increases the “receipts of the general fund” by $275,000 to include “unbudgeted receipts from surplus from prior year.”
Also under new business is approval of the amended interlocal agreement between Glasgow and Barren County for animal control purposes.
As Richard Alexander, attorney with Richardson, Gardner & Alexander, explained via email to Byrd the amended interlocal agreement “is an attempt to compile all the various documents [made over the past 28 years whenever the agreement was modified or supplemented] into a new comprehensive set of documents which will be effective for the next several years.”
According to the same email the new agreement creates a “joint animal control board” comprised of seven members — which includes a city council member, a member of the fiscal court, Glasgow’s police chief, Barren County’s Sheriff, a veterinarian, a citizen of Barren County jointly appointed for a two year term and the city animal control officer — and spells out its powers and duties.
One of its powers includes “elect[ing] to use a third-party animal control facility” which is included in the same attachment and is entitled “Animal Control Facility Use Agreement.” The agreement is between the animal control board and BRAWA.
“This facility use agreement is very specific and it deals what each party is responsible for providing,” Alexander wrote in the email.
For a flat rental fee of $84,000 per year BRAWA agrees to have an animal control designated space, animal control access, feed and care for the animals. The agreement goes into effect at the time “the last party signs the agreement” and runs through June 30, 2025 with an automatic one year renewal in years after.
Also on the agenda is approval of nursing home bonds, a subject which was initially discussed during the Jan. 22 fiscal court meeting. In short, a 501(c)(3) organization is purchasing roughly 30 “skilled nursing homes and rehabilitation centers” across Tennessee and Kentucky and need approval of each county official where they are planning to purchase facilities. Two of these are in Barren County — Barren County Nursing and Rehabilitation and Glenview Health and Rehab.
“The federal tax code imposes several hoops that these [nonprofit] organizations have to jump through in order to get bonds for these purchases,” Callie Kidwell with Dinsmore & Shohl in Louisville said during the Jan. 22 meeting. “One of which is getting the approval of the highest ranking elected official in each county where these facilities are located [and] two are in Barren County.”
This approval is necessary to issue bonds for the purchase of the facilities. Kidwell informed the court that the county would not be incurring debt as a result of the bonds and was just seeking Byrd’s approval.
