Arson charges increased in Dugard case

Jeffrey Dugard had a not-guilty plea entered on his behalf after he was reindicted by a Barren County grand jury for an arson he allegedly committed last year.

Dugard, 59, was arrested on Nov. 26, 2024 by the Glasgow Police Department for setting fire to a vehicle owned by Lessenberry Do It Center. In January he was indicted on charges of third-degree arson, first-degree criminal mischief and third-degree criminal trespassing. However, in this most recent list of indictments, Dugard’s third-degree arson charge was changed to a second-degree arson charge.

Assistant Commonwealth’s Attorney Resa Gardner said the charge should have initially been second-degree since, for arson charges, a vehicle is considered by the commonwealth to be a building, which is one of the requisites of second-degree arson.

Circuit Judge John Alexander, at the request of Gardner, dismissed Dugard’s earlier indictment “without prejudice” — meaning the charges are dropped, but the prosecutor can potentially refile them.

A not-guilty plea was entered in the new case by his attorney and the next pretrial hearing was scheduled for March 31 at 1 p.m.

Second-degree arson is a class B felony whereas third-degree arson is a class D felony.
