A suppression hearing has been scheduled in a federal court case involving child sexual abuse.
Chad Delucenay, through his lawyer Travis Lock, filed a motion to suppress his earlier comments made during “a custodial interrogation to which he was subjected [to] by law enforcement officials on June 29, 2023” until the government can prove that he made the statements after being given “adequate and effective” Miranda Warnings, the motion stated.
The United States of America, which is the plaintiff in this criminal case, argued that his suppression motion should be denied without a formal hearing because “Delucenay’s motion is based on a general allegation of a Miranda violation,” an Oct. 31 motion filed by Assistant United States Attorneys Nicholas Rabold and Danielle Yannelli stated.
Magistrate Judge H. Brent Brennenstuhl scheduled a suppression hearing for Dec. 16 at 10 a.m. in Bowling Green.
Delucenay was indicted by a Barren County grand jury in November 2023 on 10 counts of promoting a minor under 16 years old in a sexual performance.
