Judge schedules hearing in mother-daughter murder case

Matters related to how an indictment occurred for one of two co-defendants in a murder case were the primary topic of a brief preliminary hearing Monday afternoon in Barren Circuit Court.
Donna Cheryl Logsdon, 71, and her daughter, Cheryl Leighanne Bennett, 46, of Glasgow are each facing a charge of murder – accused of “acting alone or in cooperation with another” to kill Michael “Mickey” O. Logsdon on or about July 9 by turning off the BiPap machine he needed to breathe, according to the indictments returned against them by a grand jury Jan. 13. BiPap is the abbreviation for bilevel positive airway pressure.
Donna Logsdon was Mickey Logsdon’s wife; Bennett is their daughter.

They appeared Monday with defense attorney Johnny Bell, who had filed a motion taking issue with the legal sufficiency of the indictments – particularly Donna Logsdon’s. The prosecution has responded to the motions, and Circuit Judge John T. Alexander said Monday that a hearing should be scheduled so the issue could be decided.
After brief and, at times, rather terse statements by the attorneys, that hearing was scheduled for 8:30 a.m. March 29.
Bennett was originally arrested Nov. 3 and charged by police with murder. After a preliminary hearing in Barren District Court later that month, her case was to be forwarded to a grand jury. She was lodged at the Barren County Detention Center until her release Nov. 23 on a $500,000 cash bond, with 10 percent required up front.
Donna Logsdon was arrested Jan. 14, the day after the grand jury had returned an indictment against not only her daughter but her as well. She was released from the jail Jan. 30 with the same bond amount.
Their postindictment arraignments in circuit court were Feb. 6, at which time a plea of not guilty was entered on behalf of the defendants.
