Two of the three judges on a panel considering the appeal of a local police detective with regard to an interpersonal protective order issued against him affirmed the decision of the Barren County judge who issued the order.
Circuit Judge Mica Pence, who presides over the family-court proceedings here, issued the one-year IPO in February against Guy Joseph Turcotte, a former chief and now detective with the Glasgow Police Department who has been on administrative leave since a Barren County woman filed the complaint against him that led to the IPO – a civil matter – and a subsequent misdemeanor criminal charge that is ongoing.
The woman alleged that, in conjunction with inappropriate comments and other behaviors, Turcotte touched her front upper thigh at the edge of her groin area while he was in her place of employment as a customer.
Turcotte sought relief from the IPO through the Kentucky Court of Appeals, and the three-judge panel assigned the case chose not to hear oral arguments and formulated its opinion based on the written record.
On Friday, that 23-page 2-1 ruling was issued, with the affirming opinion from Judges Kelly Mark Easton and James H. Lambert and Judge Allison Jones’ separate, dissenting opinion that states she would reverse Pence’s order.
Turcotte has the option of petitioning the appellate court for rehearing, the deadline for which is Aug. 3.
